1Agreement to terms

By accessing or using the services of Zatonsky Moments LLC (“we,” “our,” or “us”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our website or services.

2Services

We provide professional photography and videography services for weddings, engagements, proposals, and related events. All bookings are subject to availability and require a signed contract and deposit to secure your date.

3Booking and payment

• A non-refundable deposit is required to reserve your date.
• The remaining balance is due before or on the date specified in your agreement.
• Payment plans may be available upon request.
• All payments are processed securely via platforms like Stripe and HoneyBook.

4Copyright & usage

All images and videos are protected under copyright law. Zatonsky Moments LLC retains copyright unless otherwise agreed in writing. Clients are granted personal use rights; commercial use requires prior written permission.

Clients may request to opt out of promotional or portfolio usage of their materials, if agreed prior to the event. A full copyright buyout is available upon request and subject to a separate agreement and fee.

5Client responsibilities

Clients are responsible for providing accurate event details, timelines, and ensuring access to venues. For venues requiring proof of insurance, we can provide a Certificate of Insurance (COI) upon request. Additional endorsements may incur fees.

6Rescheduling & cancellation

If rescheduling becomes necessary, please inform us as early as possible. Deposits remain non-refundable but may be transferable if the new date is available. Cancellations result in forfeiture of the deposit and may incur additional charges based on timing.

7Limitation of liability

While we take all reasonable precautions to ensure a smooth experience, Zatonsky Moments LLC is not liable for circumstances beyond our control (e.g., weather, venue limitations, or technical failure). Liability is limited to the total amount paid for our services.

7ASuper 8 analog-film services

Super 8 services are subject to limited availability and must be confirmed for the Client’s specific date and session before booking. Super 8 is captured with vintage analog equipment and physical motion-picture film, then developed and scanned by a laboratory. Grain, exposure variation, light leaks, frame irregularities, and similar imperfections are inherent characteristics of the format. The Client understands that vintage equipment, film stock, and laboratory processing or scanning may occasionally fail despite reasonable care.

If a mechanical equipment failure, film-stock failure, or laboratory processing or scanning failure results in no usable Super 8 footage from the event or session, Company will refund all amounts paid specifically for the affected Super 8 service, including any additional-cartridge charges. This refund is the Client’s exclusive remedy for failure to deliver usable Super 8 footage and does not affect photography, digital videography, editing, or other services successfully performed or delivered.

8SMS and email communication

By submitting an inquiry, you consent to receive SMS and email updates related to your request and our services. Message and data rates may apply. You may opt out of SMS by replying STOP. Reply START to re-subscribe, or HELP for assistance. Communication is subject to our Privacy Policy.

9Privacy & data

We value your privacy. All personal information is handled securely and in accordance with our Privacy Policy. We do not share or sell personal data, except as required to provide our services through trusted partners.

10Governing law

These Terms are governed by and construed in accordance with the laws of the State of California. Any disputes shall be resolved exclusively in the courts of California.

11Updates to terms

We may revise these Terms periodically. Updates take effect immediately upon publication. Please review this page regularly to stay informed.
